Constellation Travel Co. LLC - Client Terms & Conditions
1. Introduction
Welcome to Constellation Travel Co LLC. These Terms & Conditions govern the relationship between you (the client) and Constellation Travel Co LLC regarding travel planning and booking services. By engaging our services, you agree to comply with these terms.
2. Services Provided
Constellation Travel Co LLC specializes in Family and Luxury Travel, offering itinerary planning, travel bookings, and related services. We work with airlines, hotels, tour operators, cruise lines, and ground transportation providers. Clients are responsible for reviewing and agreeing to the terms of third-party suppliers, which will be reasonably provided during the booking process.
3. Booking Process
Clients begin by submitting an inquiry form, followed by an intake call to discuss travel needs and budget. Contracts are required for group travel (8 or more travelers).
4. Payment Terms
A non-refundable planning fee must be paid in full before any services commence.
Final payments are due per the deadlines set by suppliers. These deadlines will be communicated upon booking.
Currently, we accept credit cards as a payment method, with plans to expand payment options in the future.
5. Cancellation & Refund Policy
Planning fees are non-refundable.
Trip bookings are refundable based on the rates booked, supplier policies, and travel insurance coverage.
Constellation Travel Co LLC does not charge cancellation fees; however, clients are subject to supplier cancellation fees, which will be provided prior to booking.
If a supplier cancels a booking, rebooking options will be provided at no extra charge. The rebooking must have similar elements to the original booking (i.e. same number of days, same number of people, same number of tours, etc.), otherwise additional planning fees may be charged.
For cancellations due to natural disasters, pandemics, war, or other force majeure events, clients must refer to their travel insurance and/or supplier cancellation policies. Rebooking to a different destination within the same parameters of the original trip (i.e. same number of days, same number of people, same number of tours, etc.) will be offered at no additional cost.
6. Travel Insurance
We strongly recommend travel insurance to protect against unforeseen circumstances. Clients who decline insurance must sign a waiver acknowledging that Constellation Travel Co LLC is not responsible for losses due to lack of coverage.
7. Liability Disclaimer
Constellation Travel Co LLC acts as an agent for third-party suppliers and is not responsible for their actions, omissions, or service failures.
We are not liable for delays, cancellations, accidents, injuries, losses, or damages incurred during travel.
8. Client Responsibilities
Clients are responsible for ensuring they meet all travel requirements, including valid passports and visas.
Clients are responsible for their conduct while traveling and any consequences arising from their behavior.
Any additional costs incurred due to non-compliance with travel regulations are the client's responsibility.
9. Dispute Resolution
Any disputes arising from these Terms & Conditions will be resolved through mediation or arbitration before pursuing legal action.
The governing law for all disputes will be the laws of the State of Michigan.
Any legal proceedings must be filed in Michigan courts.
10. Amendments & Updates
Constellation Travel Co LLC reserves the right to update these Terms & Conditions at any time. Clients will be notified of significant changes. By proceeding with Constellation Travel Co LLC, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
Credit Card Authorization Terms & Conditions
1. Authorization & Consent
By providing your credit card information to Constellation Travel Co LLC ("the Company"), you authorize the Company to charge your card for travel planning fees and for payments made on your behalf to third-party suppliers, including but not limited to airlines, hotels, tour operators, cruise lines, and ground transportation providers. You acknowledge that charges will be processed in accordance with the payment schedules set by suppliers and communicated to you upon booking. Your card will not be processed without communication from the Company prior to the transaction unless otherwise discussed between you and the Company.
2. Payment Terms
Planning fees must be paid in full prior to any services being rendered and are non-refundable.
Deposits and/or full payments for bookings are determined by suppliers and must be paid at the time of booking to secure your reservtation. By authorizing these payments, you agree to the supplier’s terms and conditions, including their cancellation and refund policies.
This authorization allows Constellation Travel Co LLC to process multiple payments as required for deposits, balances, and final payments, based on the agreed-upon terms. Your card will not be processed without communication from the Company prior to the transaction unless otherwise discussed between you and the Company.
3. Cancellation, Refunds & Additional Charges
Refunds for bookings are subject to the policies of the respective suppliers. Constellation Travel Co LLC does not provide refunds for supplier-related transactions, as they are processed by the supplier directly.
Supplier cancellation fees, if applicable, will be disclosed prior to booking and will be charged to your credit card as agreed by the supplier.
In the event of a declined payment, a late fee may be applied by the supplier if the payment is not rectified within the supplier’s deadline.
You acknowledge that chargebacks or disputes for authorized payments may result in additional administrative fees and legal action if necessary.
4. Liability Disclaimer
Constellation Travel Co LLC acts as an agent for third-party suppliers and is not responsible for their service failures, cancellations, or changes.
You agree to resolve any disputes regarding supplier services directly with the supplier, following their policies and procedures. The Company will assist you in any way possible if disputes between you and the supplier are necessary.
The Company is not liable for any losses or penalties resulting from payment delays due to credit card issues, transaction failures, or declined payments.
5. Dispute Resolution
Any disputes related to charges must be reported to Constellation Travel Co LLC within 7 days of the transaction.
If a dispute arises, we will make reasonable efforts to resolve it directly with you. If necessary, disputes will be handled through mediation or arbitration before legal proceedings are pursued.
This agreement is governed by the laws of the State of Michigan. Any legal claims must be filed within Michigan’s jurisdiction.
6. Agreement & Signature
By providing your credit card details, you acknowledge that you have read, understood, and agreed to these terms. You authorize Constellation Travel Co LLC to charge your card as outlined above and confirm that you are the authorized cardholder.
